Refund Policy and Right of Withdrawal
1. Summary
- Lekty'Books and AI Tokens are digital content supplied immediately.
- At the time of payment, you expressly request immediate access and expressly waive your right of withdrawal of 14 days (mandatory checkbox).
- Accordingly, once access has been granted, the order is not refundable, except in the case of: (i) a lack of conformity or (ii) an error attributable to Lektify or the Creator.
- For the monthly subscription, you may cancel at any time; access continues until the end of the paid period, with no proration or refund for that period.
2. Principle: no withdrawal for digital content supplied immediately
As a rule, a consumer has 14 days to withdraw from a distance purchase (Article L.221-18 of the French Consumer Code (Code de la consommation)). However, Article L.221-28, 13° excludes this right for the supply of digital content not supplied on a tangible medium whose performance has begun before the end of the withdrawal period, provided that the consumer has expressly: (i) given prior consent to performance before the end of the period, and (ii) acknowledged that he or she will lose the right of withdrawal.
Lekty'Books (access to interactive digital content enhanced by AI) and AI Tokens fall within this category. The exception applies only if both express consents are obtained and proven.
3. How the checkbox works at payment
When confirming an order for digital content, the Buyer must check a dedicated box, which is not pre-checked, separate from the acceptance of the General Terms and Conditions of Sale (CGV), bearing a statement such as:
☐ "I expressly request immediate access to this digital content before the end of the 14-day withdrawal period, and I acknowledge that I expressly waive my right of withdrawal once access has been granted."
This box is not pre-checked and is separate from the acceptance of the CGV; the double consent (agreement to immediate performance and waiver) is recorded and logged as evidence (Article L.221-9); a confirmation on a durable medium is sent to the Buyer (order confirmation email).
4. Special case: the recurring monthly subscription
You may cancel your subscription at any time through the payment service provider's customer portal. Access remains open until the end of the current period, with no proration or refund for that period. No renewal takes place after cancellation. At each renewal date, a reminder informs you that access continues and that cancellation remains possible at any time.
5. Cases in which a refund is granted
A refund (full or partial) may be granted in the following cases:
- Lack of conformity of the content (content that is inaccessible, seriously defective, or does not match its description): legal guarantee of conformity (Article L.224-25-1 et seq.), owed by the Creator, as seller of the Lekty'Book, with technical assistance from Lektify;
- Double billing / technical payment error;
- Failure attributable to the Creator or to Lektify preventing the supply of the paid service.
In all cases, the refund covers the price actually paid: if the purchase benefited from a promotional price or a promo code, it is that reduced price that is refunded. An offer launched after a purchase does not give rise to a refund of the difference.
6. Who issues the refund? (Direct Charge architecture)
Due to the Stripe Connect Direct Charge architecture, the price of Lekty'Books is collected directly by the Creator. Accordingly:
- refunds for B2C2C sales are the responsibility of the Creator, as seller (since the money is in the Creator's connected account); Lektify may facilitate the operation technically;
- Lektify then applies its commission recovery clause (clawback) (see CGV, Article 8.3);
- AI Tokens and the Studio subscription, sold directly by Lektify, are refunded by Lektify in the cases accepted above.
7. How to request a refund
Send your request to contact@lektify.app, specifying: your user ID, the order reference, the reason, and any supporting documents. You will receive a response as soon as possible.
In the event of a persistent disagreement, you may use consumer mediation (médiation de la consommation) free of charge:
Consumer mediator (médiateur de la consommation): CM2C (Centre de Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris. Tel.: 01 89 47 00 14. Online submission: https://www.cm2c.net/declarer-un-litige.php. Email: litiges@cm2c.net. The consumer may file a request directly online on the mediator's website.
For cross-border disputes within the European Union, the consumer may also contact the European Consumer Center France (Centre européen des consommateurs France) (www.europe-consommateurs.eu), which provides information and assistance free of charge.
8. Legal guarantees
Notwithstanding this policy, the consumer retains the benefit of the legal guarantee of conformity for digital content and services (Article L.224-25-1 et seq. of the French Consumer Code). These guarantees are a matter of public policy (ordre public) and cannot be excluded by contract.
