Affiliate Program Terms

These terms govern the Lektify affiliate (referral) program, operated by BENYWEB STUDIO (SASU, trade name Lektify, RCS Lyon 130 420 821, 64 rue Waldeck Rousseau, 69006 Lyon, VAT FR74130420821), hereinafter "Lektify." They supplement the General Terms and Conditions of Sale (Article 3.6). In the event of any conflict, these terms prevail for all matters relating to the affiliate program.

1. Acceptance

You join the program by accepting these terms from your "My Affiliation" ("Mon affiliation") area. Lektify retains proof of your acceptance (version of the text, date, and account). Until you have accepted them and provided your billing status (Article 9), commissions accrue to your account but are not paid out to you.

2. Who can be an affiliate

The program is open to Creators who hold an active paid Studio subscription (Creator or Business). A commission is owed only for payments received while your own paid subscription is active.

3. How a referee is linked to you

A new Creator (the "Referee") is linked to you:

• if they sign up within 60 days after following your referral link, where the visitor has accepted the referral cookie;
• or if they enter your referral code when signing up.

The link is unique and permanent: a Referee has only one referrer, in principle the first one identified, and this link does not change thereafter.

4. Your commission

You receive a commission of 20% of the amount, excluding taxes, of the Studio subscription actually paid by your Referee (net of any discounts), for as long as their subscription is active, with no time limit.

If you are a Builder, the commission is 40% on the equivalent of each Referee's first 3 monthly payments, then 20%. For an annual subscription, the portion corresponding to the first 3 monthly payments is calculated on a pro rata basis.

The commission applies neither to the sales your Referee makes to their readers nor to their purchases of AI Tokens. It ends when your Referee cancels their Studio subscription.

5. AI Token welcome bonus

Upon your Referee's first payment, you receive 2,000 AI Tokens and your Referee receives 1,000 (3,000 and 1,500 respectively if you are a Builder). These bonuses are neither refundable nor convertible into cash.

6. What is prohibited

To preserve trust in Lektify, it is prohibited:

• to refer yourself, directly or through a third-party account, or to create multiple accounts;
• to purchase advertising on the name "Lektify" or its variants (keywords, domain names, social media accounts), or to present yourself as Lektify;
• to send unsolicited messages (emails, text messages, mass private messages);
• to make misleading promises about Lektify or about the income it may allegedly generate;
• to offer your Referees any financial consideration for signing up, without Lektify's written consent.

Lektify automatically reviews suspicious cases. In the event of a breach, the commissions concerned are canceled and Lektify may terminate your participation, after informing you.

7. When and how you are paid

Each commission becomes available 30 days after your Referee's payment. This period allows for any canceled or disputed payment to be taken into account (Article 8).

Available commissions are paid automatically on the 1st of each month, using the method you choose in your area:

• as a credit toward your own Lektify subscription, with no minimum amount;
• by transfer to your Lektify payment account (Stripe), once a cumulative total of €50 is reached; below that amount, the balance is carried over to the following month. Transfers are reserved for professionals (micro-enterprise (micro-entreprise) or company): if you are an individual, your commissions are applied solely as a credit toward your subscription.

Commissions are stated excluding taxes. If you are subject to VAT, VAT at the applicable rate is added and paid to you at the same time.

8. Canceled or disputed payment

If a Referee's payment is canceled or disputed (for example, a dispute filed with their bank, fraud, or an exceptional goodwill gesture), the corresponding commission is no longer owed:

• if it has not yet been paid to you, it is simply canceled;
• if it has already been paid to you, its amount is deducted from your subsequent commissions. Lektify never asks you for repayment: any amount that could not be deducted within 12 months is waived.

9. Taxation and self-billing mandate

You specify your billing status in your area: individual, professional exempt from VAT, or professional subject to VAT, together with the corresponding information (name or company name, address, SIREN, VAT number). Commissions are income that you must report according to your status. You are solely responsible for your tax and social security obligations and for the accuracy of the information you provide.

Self-billing mandate (professionals). If you are a professional, by accepting these terms you authorize BENYWEB STUDIO to issue, in your name and on your behalf, the invoices corresponding to your commissions (Article 289, I-2 of the French General Tax Code (Code général des impôts)). Each invoice bears the statement "Autofacturation" (self-billing), a number from a dedicated sequence, and the VAT applicable according to the status you have declared (or the statement of exemption under the VAT franchise scheme (franchise en base de TVA)). A copy of each invoice is made available to you in your area. You undertake to keep your status and billing information up to date, and you have 30 days from the date an invoice is made available to dispute it; after this period, it is deemed accepted. You may terminate this mandate at any time by ending your participation in the program.

10. Term and end of participation

Your participation lasts for as long as you wish. You may end it at any time by writing to contact@lektify.app. Commissions already available remain owed to you and are paid in accordance with Article 7. Lektify may terminate the program by giving you at least 30 days' notice; commissions earned before that date remain owed.

11. Changes to the terms

Lektify may amend these terms. Any new version is presented to you in your area and takes effect no earlier than 30 days after it is presented; you are invited to accept it. Commissions earned under a previous version remain governed by that version.

12. Personal data

In your area, your Referees appear only in masked form (for example, "so…@g…"). The processing of your data and that of your Referees is described in the Privacy Policy.

13. Governing law

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first; failing that, the competent courts are those within the jurisdiction of the Court of Appeal of Lyon (cour d'appel de Lyon).
